Privacy Policy

This Privacy Policy describes how The Projekt LLC, a Florida limited liability company, together with its wholly owned subsidiary Rogue Cinematography LLC and its internal operating divisions (collectively, "The Projekt," "we," "our," or "us"), collects, uses, stores, shares, and protects your personal information across all of our platforms, services, and products.

By using any of our services, visiting our websites, or engaging with us through any channel, you agree to the collection and use of your information as described below. If you do not agree, please do not use our services.

The Projekt operates the following divisions under a single legal entity: Rogue Cinematography (media and production), The Watchman (headhunting and talent sourcing), The Forge (community and education), Founders Expansion (product development and asset lab), and Build With The Public (open source and humanitarian tools). All divisions share a single data governance framework described in this policy.

1. Information We Collect

We collect the following categories of information depending on how you interact with us:

Contact Information: Name, email address, phone number, mailing address, and any other contact details you provide directly through forms, account creation, or correspondence.

Payment and Billing Information: Payment card details, billing address, transaction history, and related financial data. Payment processing is handled by our authorized third-party processors (Stripe, PayPal, and Helcim). We do not store full payment card numbers on our systems.

Account Information: Username, password (stored in hashed form), account preferences, and profile information you provide when creating an account on any of our platforms.

Usage Data: Information about how you interact with our platforms, including pages visited, features used, time spent on pages, click patterns, referring URLs, and device or browser information.

Analytics Data: Data collected through third-party analytics tools, including Google Analytics, Meta Pixel, and Microsoft Clarity. This may include anonymized behavioral data, session recordings (with personal data masked), heatmaps, and aggregated traffic patterns.

Communications Data: Records of your communications with us, including emails, chat messages, support requests, and any feedback or content you submit.

Service-Specific Data: Depending on the division or product you engage with, we may collect additional information such as audio files (Sayso), freelancer profiles and portfolios (Conduit), candidate information (The Watchman), or project briefs and brand assets (core services).

2. How We Collect Information

Directly from you: When you fill out forms, create accounts, make purchases, submit content, contact us, or otherwise provide information to us voluntarily.

Automatically: Through cookies, web beacons, pixels, and similar tracking technologies when you use our websites or platforms. See Section 10 (Cookies and Tracking Technologies) for details.

From third parties: From payment processors during transactions, from analytics platforms, from social media platforms if you interact with our content, and from publicly available sources when relevant to the services we provide.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To deliver, maintain, and improve our services across all divisions.
  • To create and manage your account and process transactions.
  • To communicate with you about your account, services, updates, and support inquiries.
  • To personalize your experience and provide content and recommendations relevant to your interests.
  • To detect, prevent, and address fraud, security incidents, and technical issues.
  • To analyze usage trends, measure the performance of our services, and conduct internal research to improve our offerings.
  • To comply with legal obligations, enforce our terms, and protect our rights and the rights of others.
  • To send you marketing communications where you have opted in or where permitted by law, with the ability to opt out at any time.
  • To facilitate hiring and placement services through The Watchman division, including candidate screening and matching.

4. Sensitive Data

Under applicable privacy laws, certain categories of personal information are considered "sensitive data" and require additional protections. We consider the following to be sensitive data:

  • Racial or ethnic origin.
  • Religious or philosophical beliefs.
  • Health information, including mental or physical health conditions.
  • Sexual orientation or sex life.
  • Citizenship or immigration status.
  • Genetic data.
  • Biometric data processed for the purpose of identifying a specific individual.
  • Precise geolocation data.
  • Personal data of a known child under the age of thirteen (13).

We do not process sensitive data without your affirmative, opt-in consent, except where required or permitted by applicable law (for example, to comply with a legal obligation or to protect someone's safety). If we need to collect or process sensitive data in connection with our services, we will notify you and request your explicit consent before doing so.

5. Biometric Data

As of the effective date of this policy, The Projekt does not collect, process, or store biometric data (such as fingerprints, facial geometry, voiceprints, or retina scans) for the purpose of identifying individuals.

In the course of Rogue Cinematography's production work, video and audio recordings may capture visual or vocal characteristics of individuals. These recordings are treated as media content, not biometric identifiers, and are not processed through biometric recognition systems.

If The Projekt's practices change and biometric data collection becomes necessary for any service or feature, we will update this policy and obtain your separate, informed consent before collecting or processing any biometric information, in compliance with applicable biometric privacy laws, including the Illinois Biometric Information Privacy Act (BIPA) and similar state statutes.

6. Data Sharing Across Divisions

Because The Watchman, The Forge, Founders Expansion, Build With The Public, and Rogue Cinematography all operate as divisions or subsidiaries of The Projekt LLC (a single legal entity), your data may be shared internally between these divisions to provide a unified customer experience, coordinate services, and maintain accurate records.

For example, if you use The Watchman for hiring services and also engage our core web development services, we may reference your account information across both engagements to streamline communication and billing. This internal sharing does not constitute a sale or transfer of your data to a third party.

7. Use of Client Content and Media for Promotional Purposes

In the course of delivering our services, The Projekt and its divisions (including Rogue Cinematography) may produce deliverables, media, photography, videography, and other creative assets connected to your engagement. As described in our Terms of Service (Section 7, Client Content and Media Usage License), by engaging our services you grant us a license to use these materials for our own marketing, portfolio, advertising, and content creation purposes across all channels and divisions.

From a privacy standpoint, this means that project-related media, screenshots of delivered work, and general descriptions of the engagement may appear in The Projekt's public-facing materials, including YouTube content, social media, paid ads, website portfolios, and presentations. We will not include your personal data (such as your name, email, or contact information) in promotional content without your separate written consent.

If you prefer that your engagement not be featured publicly, you may opt out in writing by contacting legal@wearetheprojekt.com. For full details on the scope of this license and the opt-out process, please refer to Section 7 of our Terms of Service.

8. Sharing with Third Parties

We do not sell your personal information. We do not share your data for third-party advertising or marketing purposes.

We may share your information with the following categories of recipients, and only to the extent necessary:

  • Authorized service providers who perform services on our behalf, such as payment processors (Stripe, PayPal, Helcim), analytics providers (Google Analytics, Meta Pixel, Microsoft Clarity), hosting providers, and email service providers.
  • Legal authorities when required by law, regulation, legal process, or enforceable governmental request, or when we believe disclosure is necessary to protect the rights, property, or safety of The Projekt, our users, or the public.
  • Professional advisors such as attorneys, accountants, and auditors, in the course of the professional services they provide to us.
  • Business transfer partners in the event of a merger, acquisition, reorganization, or sale of assets, subject to the receiving party agreeing to honor the terms of this policy.

9. Data Retention

We retain your personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements.

As a general guideline, we retain active account data for the duration of your relationship with us and for a period of twenty-four (24) months following your last interaction with our services. After this period, your data will be securely deleted or anonymized unless a longer retention period is required by law or for legitimate business purposes (such as maintaining financial records for tax compliance).

You may request deletion of your data at any time by contacting us at legal@wearetheprojekt.com. We will respond to deletion requests within thirty (30) days of receipt.

10. Cookies and Tracking Technologies

Our websites and platforms use cookies and similar tracking technologies to collect usage data, remember your preferences, and analyze traffic patterns.

Essential Cookies: Required for core website functionality such as authentication, security, and session management. These cannot be disabled.

Analytics Cookies: Used to understand how visitors interact with our websites. We use Google Analytics, Microsoft Clarity, and Meta Pixel for this purpose. These tools may collect anonymized behavioral data, session recordings, and aggregated metrics.

Preference Cookies: Used to remember your settings, language preferences, and other choices you make on our platforms.

You can manage your cookie preferences through your browser settings. Most browsers allow you to block or delete cookies. Please note that disabling certain cookies may affect the functionality of our services.

We recognize and honor Global Privacy Control (GPC) signals and other universal opt-out mechanisms where required by applicable law.

11. Data Security

We take the security of your personal information seriously and implement reasonable technical, administrative, and physical safeguards to protect it against unauthorized access, use, alteration, or destruction. These measures include, but are not limited to:

  • Encryption of data in transit using TLS/SSL protocols.
  • Access controls that limit data access to authorized personnel based on role and necessity.
  • Contractor security obligations, including signed security and access agreements, multi-factor authentication requirements, and restrictions on data storage and handling.
  • Regular review of access permissions and monitoring of system activity.
  • Incident response procedures to detect, contain, and remediate security events.

While we strive to protect your information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, but we are committed to maintaining commercially reasonable protections.

12. International Data Transfers

The Projekt operates with team members and contractors located in multiple countries, including the United States and Nigeria. Your personal information may be transferred to, stored in, and processed in countries other than the country in which it was originally collected.

When we transfer personal data across borders, we require all recipients to maintain security and confidentiality standards consistent with this policy and our internal contractor agreements. For users in the European Union or United Kingdom, we rely on appropriate safeguards such as standard contractual clauses or your explicit consent to authorize such transfers.

13. Contractor and Team Member Data

In addition to client and user data, The Projekt collects and processes personal information from its independent contractors and team members for the purposes of engagement management, payment processing, communication, and compliance with legal and contractual obligations.

Contractor personal data (such as name, contact details, payment information, and work-related communications) is handled in accordance with this Privacy Policy and the terms of each contractor's signed agreement, including the Independent Contractor Agreement and the Contractor Security and Access Agreement. Contractor data is subject to the same security standards, access controls, and retention practices described in this policy.

14. Data Breach Notification

In the event of a data breach that compromises your personal information, we will notify affected individuals and the appropriate regulatory authorities as required by applicable law. Under the Florida Information Protection Act (FIPA), we will provide notification within thirty (30) days of determining that a breach has occurred. Notifications will be sent via email to the address associated with your account, or by other means if email is not available.

15. Children's Privacy

Our services are not directed to children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal data from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly.

Users between the ages of 13 and 18 may access certain free resources with verified parental consent, as described in our Terms of Service. We comply with the Children's Online Privacy Protection Act (COPPA) and all applicable state laws regarding the collection and processing of minors' data.

16. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information under applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and the growing body of U.S. state privacy laws (including those in Virginia, Colorado, Connecticut, Indiana, Kentucky, Rhode Island, and others).

These rights may include:

  • The right to know what personal information we collect about you and how it is used.
  • The right to access and receive a copy of your personal information.
  • The right to correct inaccurate personal information.
  • The right to request deletion of your personal information, subject to certain exceptions.
  • The right to opt out of the sale or sharing of your personal information (we do not sell personal data).
  • The right to opt out of targeted advertising and certain profiling activities.
  • The right to data portability, where applicable.
  • The right to withdraw consent at any time, where processing is based on consent.
  • The right to appeal a decision regarding your privacy request.

To exercise any of these rights, please contact us at legal@wearetheprojekt.com. We will respond to verified requests within thirty (30) days (or within forty-five (45) days where permitted by law). We will not discriminate against you for exercising your privacy rights.

We require affirmative user consent prior to collecting personal data under applicable laws (such as GDPR and CCPA) and maintain logs of such consent, including the timestamp and source of acceptance (for example, a checkbox at account creation or checkout).

17. Verifying Privacy Requests

When we receive a request to access, correct, delete, or export personal information, we take reasonable steps to verify the identity of the person making the request before processing it. This is to protect your information from unauthorized access or deletion.

Verification methods may include confirming your identity through the email address associated with your account, matching account credentials, or, for requests involving sensitive data or high-risk actions, requesting a copy of a government-issued identification document. We will only use information provided for verification purposes to process and verify the request.

If we are unable to verify your identity to a reasonable degree of certainty, we may ask for additional information or may decline the request. We will communicate the reason for any denial and explain how you may appeal the decision.

18. Do Not Track and Universal Opt-Out Signals

We recognize and respond to Global Privacy Control (GPC) signals and similar browser-based universal opt-out mechanisms. When we detect a valid GPC signal, we treat it as a request to opt out of the sale or sharing of personal information and will process it accordingly.

For other "Do Not Track" browser signals that do not have a uniform standard, our response may vary depending on the applicable legal requirements in your jurisdiction.

19. AI and Automated Decision-Making

Certain features of our services may use artificial intelligence, machine learning, or other automated tools to assist with tasks such as content personalization, data analysis, or service recommendations. These tools are used to support and improve the quality of our services.

We do not use automated decision-making as the sole basis for decisions that produce legal effects or similarly significant effects on individuals without appropriate human oversight. We participate in certain referral and affiliate programs (such as through banking, domain, and e-commerce partners). These partnerships do not grant those third parties access to your personal information beyond what is necessary to process referrals.
